New York Car Insurance Minimums, Fines And Penalties

New York is a no-fault state which is a policy to help keep the costs of insurance to a minimum and reduce the amount of car-related court litigation filed yearly. Since New York is a no-fault state all motorist are going to need Personal Injury Protection (PIP) insurance which covers lose of wages, any death benefits, and medical expenses without regard to who is “at-fault” during the accident.

The set minimum limits for New York is 25,000/50,000/10,000 for bodily injury liability and property damage liability which are as follows:

CoverageNew York Minimum Liability CoverageRecommended Auto Insurance Coverage

Property Damage$10,000$50,000
Personal Injury Protection$50,000$50,000
Uninsured / Underinsured Motorist BILN/A$50,000 / $100,000
Comprehensive CoverageN/A$500 deductible

Bodily Injury Liability

Covers damages to the other driver and their passengers when the insured driver is revealed to be at-fault in an accident. Under the minimum coverage, the insurance will pay $25,000 to a single person and up to $50,000 for multiple passengers concerned in the accident.

Property Damage Liability

In the event the other person’s car, public property like places of business, guard rails, and road signs, or private property like an individual’s home is damaged in an accident, an effective minimum property damage liability policy will pay up to $10,000 for repairs.

Since New York has one of the nations highest uninsured motorist laws the state requires all drivers to have uninsured motorist protection. Another interesting fact too is NY has implemented stricter texting and driving laws which adds points to your license which can skyrocket your auto insurance rates.

Although the state has minimums the average coverage per driver in NY is:

  • Property Damage Liability – 50,000
  • Uninsured Motorist Protection – 25,000/50,000
  • Personal Injury Protection – $200 deductible

Driving without insurance in NY

There are severe penalties in NY when driving without insurance especially when there has been a car accident. Anybody caught in an accident while uninsured could lose their driver’s license and registration for a minimum of a year.

This is the penalty no matter whether the uninsured party is not at-fault, as the penalty is imposed on whichever automobile owner is not carrying insurance.

When a driver has lost their registration they are required to turn over the license plate to the Department of Motor Vehicles (DMV) and they will be fine $1,500 plus the driver will have to pay $750 reinstatement fee.

Be sure not to let your insurance lapse even if you are not driving the vehicle since the penalty for driving with lapsed insurance is $8 to $12 each day which can add up to hundreds of dollars if the lapse period is only sixty days.
